Publication of the Draft Regulations of the Upstream Petroleum Resources Development Act for public comment

On 14 April 2025, the Minister of Mineral and Petroleum Resources, Mr Gwede Mantashe, published the draft Regulations for public comment in GN.6123 GG.52507.

  • On 14 April 2025, the Department of Mineral Resources and Energy (DMRE) published the draft Regulations of the Upstream Petroleum Resources Development Act, No. 23 of 2024 (Regulations) for comment.
  • The purpose of the Regulations is to provide for the implementation of the Upstream Petroleum Resources Development Act, No. 23 of 2024 (Upstream Act) which was published in the Government Gazette on 29 October 2024 but has not yet come into effect.
  • Stakeholders have until 14 May 2025 to provide comments.

The Regulations provide the specific guidelines and procedures to be applied in the implementation of the Upstream Act. Please see our previous alert for an unpacking of the Upstream Act.
