Announcement: Effective date of Employment Equity Act Amendments

On 14 April 2023, President Cyril Ramaphosa signed the Employment Equity Amendment Act 4 of 2022 into law, amending the Employment Equity Act 55 of 1998. Although no effective date has yet been proclaimed, there are unverified reports suggesting implementation may begin in January 2025. This cannot be confirmed at this time, and we will keep you informed of any official developments.

The amendments introduce two significant changes:

  1. The amendments restrict the application of certain sections of the Employment Equity Act to a reduced group of employers, relieving the administrative burden on smaller employers.
  2. The amendments introduce sectoral numerical targets to ensure equitable representation of historically disadvantaged groups based on race, gender, and disability at all occupational levels in the workforce.

Currently, no final sectoral numerical targets have been published, nor has guidance been provided on transitional arrangements for designated employers to align their existing employment equity plans with these new targets. Details regarding these particulars may become clearer once the amendments are effective. We will continue to monitor developments and share updates as they become available.
