James explains that the Climate Change Act introduces various mechanisms to mitigate South Africa's carbon emissions while supporting the just transition to a sustainable, climate-resilient economy.

In addition to government-led adaptation plans, James says that the Act provides industry-specific mechanisms, such as the regulation of greenhouse gas reporting—currently governed under the Air Quality Act and the 2017 GHG Reporting Regulations—and the introduction of sectoral emission targets to establish tailored emissions goals for key industries, including mining. James adds that while a mining-specific Sector Emission Target has yet to be developed, the Draft Sector Emission Targets Report published in April 2024 identifies mining as one of seven priority sectors requiring a SET.

The Climate Change Act was published on 23 July 2024 and will come into operation on a date determined by Presidential proclamation in the Government Gazette.
