Big step towards greater protection of South Africa’s mega-biodiversity

South Africa is considered to be one of the world’s few megadiverse countries and contains high levels of endemism. The National Environmental: Biodiversity Act 10 of 2004 (NEMBA) was brought into effect 20 years ago, but despite the measures provided for in the NEMBA, the well-publicised exploitation of South Africa’s biodiversity has raged on. It therefore comes as no surprise that various legislative steps have now been initiated to introduce more progressive and diverse measures to protect and ensure the sustainable use of South Africa’s rich biodiversity. These steps culminated in the publication of the Biodiversity Bill by the Minister of Forestry, Fisheries and the Environment (Minister) on 24 May 2024, inviting the public to submit comments on the bill on or before 23 July2024.

NERSA’s decision on Eskom’s curtailment application pending

In terms of a consultation paper released by the National Energy Regulator of South Africa (NERSA) on 5 July 2024 (Consultation Paper), Eskom submitted an application to NERSA on 24 May 2024 requesting approval for congestion curtailment to be treated as a constrained generation ancillary service for renewable energy resources (Application). Per the Consultation Paper, “ leveraging the intermittent nature of renewable energy resources, it becomes possible to connect more resources to the grid without exceeding the capacity of the grid for most of the time ”.

The legend goes that once upon a time and in a land far, far away, Robin Hood and his merry band spent their time stealing from the rich and giving to the poor. With Little John, Friar Tuck, Maid Marian and others, Robin would rob wealthy nobles as they passed through Sherwood Forest and then distribute the valuables to needy common folk. Prince John and his barons, vexed by the actions of the outlaws, instructed the Sheriff of Nottingham to find the valuables and lock them in the castle before they were given away to the poor and lostforever.
