Don’t count your chickens before they hatch: The Competition Commission’s inquiry into the poultry industry

On 6 February 2023, the Competition Commission (Commission) published its draft terms of reference for its inquiry into the poultry industry (ToR) established in terms of section 43B of the Competition Act 89 of 1998 (Competition Act). The Commission has indicated that there are market features within the poultry industry that are likely to impede or distort competition. The features include structural indicators, the outcomes in the industry and certain conduct along the value chain. It stated that taking steps to address these market features through a market inquiry could benefit industry competitiveness and consumers through the improvement incompetition.

The environmental (and other) legislative transitions to a low-carbon economy in South Africa

South Africa is currently enjoying a much welcomed and extended reprieve from the effects of load shedding. While there is speculation that this is merely a politically motivated state of affairs, experts suggest that the increase in solar installations at household and business levels has resulted in a significant decrease in Eskom-generated energy demand, as 2,1GW of solar has been installed in the last 12 months. Furthermore, Ember Energy estimates that solar energy contributed 10,4% to South Africa’s electricity mix in February 2024. South Africa has committed to moving towards a low-carbon economy, and the recent expansion of renewable energy installations can be seen as a significant contribution towards this goal. The transition towards a low-carbon economy cannot be achieved without the reform of enablinglegislation.

The extent of business rescue practitioners’ powers to suspend a company’s contractual obligations

Chapter 6 of the Companies Act 71 of 2008 (Companies Act) confers various powers on business rescue practitioners (BRPs) once they have assumed their responsibilities to restructure the affairs of a company that has been placed under business rescue. This is achieved through the temporary supervision of the company, and the management of its affairs, business and property, by the BRP; a temporary moratorium on the rights of claimants against the company or in respect of property belonging to the company or lawfully in the possession of the company; and the development and implementation, if approved, of a business rescue plan to rescue the company by restructuring its affairs, amongst other things.
