Leila said that the legal landscape is evolving, with increasing emphasis on different types of leave, both in statutory frameworks and employer policies or contractual arrangements. Many employers, particularly those seeking to be seen as employers of choice, are introducing initiatives like mental health days or recharge days to promote employee well-being. This reflects a growing awareness of the importance of regulating working hours to allow employees to rest and to rejuvenate.
Leila emphasised that the starting point for employers is to understand their obligations regarding employee leave entitlements. For instance, employees are entitled to statutory sick leave if they are unwell. Similarly, provisions like family responsibility leave allow employees to take time off for critical family matters, such as caring for a sick child or dealing with a family bereavement. Employers must create an environment where employees feel comfortable taking the leave they are entitled to without fear of reprisal.
Leila also pointed out that one of the key considerations is how employers manage working hours. The Basic Conditions of Employment Act requires all employers, regardless of their employees' income levels, to regulate working hours in a way that considers health, safety, and family responsibilities. Employers must audit and review working patterns to ensure they are not overburdening employees and are complying with their statutory obligations. This audit is crucial for mitigating risks and ensuring that employees’ well-being is a priority.
