The proposed amendments include a change to the definitions of "designated employer" and "people with disabilities", the removal of the requirement for HPCSA certification in respect of psychological testing, the introduction of sectoral numerical targets by the Minister and the practicalities around the submission of employment equity reports.

Embracing privatisation of the rail industry in South Africa: Transnet’s Network Statement

In a move geared towards transforming the rail sector, Transnet SOC Limited (Transnet) issued its draft Network Statement (Statement) for public comment on 19 March 2024, outlining the means for privatisation of its rail network. This Statement gives effect to the rail reform set out in the National Rail Policy (adopted by Cabinet in 2022), the Freight Logistics Roadmap and the Private Sector Participation Framework. However, several elements are contentious, including the proposed minimum access fee to the rail network, proposed security measures, and the means of allocation of capacity.

Exclusive use areas: What are they, how are they created and are they all equal?

In terms of the Sectional Titles Act 95 of 1986 (Act), exclusive use areas are defined as parts of the common property for the exclusive use by the owner or owners of one or more sections in a sectional title scheme. An exclusive use area is therefore a portion of the common property which is reserved for the exclusive use of an owner of a section in the scheme. Examples of exclusive use areas can include gardens, parking bays, garages, patios, storerooms and courtyards. Section 27 of the Act regulates the rights of exclusive use of parts of commonproperty

The Constitutional Court dismisses the Minister’s application for leave to appeal ZEP judgment

On 28 June 2023, the High Court declared the decision by Dr Aaron Motsoaledi, the former Minister of Home Affairs (Minister), to terminate the Zimbabwean Exemption Permit (ZEP) unlawful, unconstitutional and invalid. This decision concerned the rights of over 178,000 ZEP holders. As a consequence, the court remitted the matter back to the Minister for reconsideration following a fair process in accordance with the Promotion of Administrative Justice Act 3 of 2000 (PAJA).
