It addresses the typical reasons for retrenchments during the pandemic and offers solutions to the issues that will arise with respect to physical meetings during consultation, by highlighting ways in which it can be done safely and efficiently. It also explores the use of a facilitator to assist in the process in respect of large-scale retrenchments.

Issues such as how one would deal with parties who frustrate the consultation process and ensuring alternatives to retrenchments do not fall foul of s187(1)(c) of the Labour Relations Act are also addressed.

Religious practice and inherent requirements of the job

The tension between religious beliefs and workplace demands was addressed in the decision of the Labour Appeal Court (LAC) in Sun International Management Limited v Sayiti (JA13/23) ZALCJHB 411 (21 October 2024). The issue to be decided was whether the employee’s dismissal was automatically unfair, given that the reason for his dismissal was his inability to perform an inherent requirement of the job, working between sunset on Friday and sunset on Saturday, because of his religious beliefs.

Unlawful termination of employment contracts: No automatic right to specific performance

In the Labour Appeal Court (LAC) case of Passenger Rail Agency of South Africa and Others v Ngoye and Others [2024 45 ILJ 1228 (LAC) the LAC affirmed the that the dispute resolution procedures in the Labour Relations Act 66 of 1995 (LRA) do not defeat an employee’s right to rely on the common law contractual recourse, provided that the applicant pleads their case on this basis, as the right to not be unfairly dismissed is not the only right that may be implicated as a result of a dismissal.

Kenya unveils Carbon Market Regulations

The gazettement of the Climate Change (Carbon Markets) Regulations, 2024 (Regulations) on 17 May 2024, has set the stage for the regulatory oversight of carbon project development and management in Kenya.
