Court orders removal of livestock from South African farm

In a recent judgment from the Land Claims Court in Moladora Trust v Mereki and Others (189/2023) ZASCA 37 (3 April 2024) , the Moladora Trust’s (Trust) appeal was upheld, resulting in a significant ruling regarding the presence of grazing animals on a farm in the North West Province. The Trust, as the owner of the property, had sought relief against the Mereki children, who were occupying the land and grazing livestock without explicit consent.

It is now well understood that any unilateral amendment to an employment contract amounts to an unfair labour practice under section 45 of the Employment Act 11 of 2007 (the Employment Act). This has recently been reiterated by the Supreme Court of Kenya in Symon Wairobi Gatuma v Kenya Breweries Limited and Three Others, Petition E023 of 2023 (the Supreme Courtdecision).   The Supreme Court decision is, however, more than just a decision on unilateral amendments to employment contracts. It addresses and provides guidance as to how to treat employees during business restructuring exercises and redundancies.

Understanding black swan events: Why an anticipatory risk management approach is the antidote

On Friday 19 July 2024, the world encountered the biggest IT outage in history when major cybersecurity company CrowdStrike released a faulty update that caused an estimated 8 million computers worldwide to crash. The event had a wide-scale impact on airline ticketing systems, point-of-sale systems and any organisation that had the CrowdStrike Falcon solution installed across its IT environment. Reports by major insurance companies estimated that the crash caused more than $5 billion in direct damages to businesses, with the healthcare and banking sectors being the hardest hit, suffering over $1 billion indamages.
