Beneficial ownership information disclosure
Pursuant to Section 93A of the Kenyan Companies Act, 2015, every company is required to keep a register of its beneficial owners. To give effect to this amendment, the Government published the Companies Beneficial Ownership Information Regulations, 2020 (Regulations), which came into effect on 13 October 2020. Companies are hence required to update their beneficial ownership E-register.

National Small Enterprise Amendment Act: Changes afoot?
On 27 September 2024, the President brought into operation certain sections of the National Small Enterprise Amendment Act 21 of 2024 (Amendment Act), which amends the National Small Enterprise Act 102 of 1996 (Principal Act). The Amendment Act was assented to by the President on 18 July 2024 and aims, inter alia , to enhance support for small and medium businesses as part of broadening participation in the economy for a greater number of South Africans. This is to enable an equitable trading environment for small enterprises, through the provision of affordable and effective access to justice, and to empower the Minister of Small Business Development (Minister) to declare certain practices in relation to small enterprises to be prohibited as unfair trading practices.

Renewable energy tax incentives to be re-energised
Section 12B of the ITA deals with, amongst other things, renewable energy tax incentives. It assists companies investing in renewable energy assets with cash flow constraints through an accelerated capital depreciation allowance on qualifying assets and supporting infrastructure. Given South Africa’s critical energy shortage and the global move to a greener energy mix, this tax incentive is a cornerstone of South Africa’s current fiscal policy.
