CDH's Finance & Banking practice advised Nedbank, RMB and Futuregrowth in relation to the provision of ZAR1,3 billion funding to Enyuka Prop Holdings for the purposes of the repurchase of all shares previously held by Emira Property Fund Limited in Enyuka Prop Holdings and the refinancing of certain existing debt.
Our Finance & Banking practice advised Nedbank Limited (acting through its Nedbank Corporate and Investment Banking division), FirstRand Bank Limited (acting through its Rand Merchant Bank division) and Futuregrowth Asset Management Proprietary Limited (acting in its capacity as agent for and on behalf of its clients) in relation to its provision of funding to Enyuka Prop Holdings Proprietary Limited for the purposes of, amongst others, the repurchase of all of the shares previously held by Emira Property Fund Limited in Enyuka Prop Holdings Proprietary Limited and the refinancing of certain existing debt.

New earnings threshold effective 1 April 2024
As of 1 April 2024, South Africans will see the implementation of the increased annual earnings threshold determined by the Minister of Employment and Labour (Minister) in the amount of R254,371.67. This represents an increase of R13,261.08 from the previous amount of R241,110.59, which has been in effect since 1 March 2023.

As a result of the decision from the Supreme Court of Appeal (SCA) in the case of Tayob and Another v Shiva Uranium (Pty) Ltd and Others ZASCA there have been, and will continue to be, burning questions surrounding which powers shift from the board to the business rescue practitioners (BRPs) once a company has been placed under business rescue supervision. Pillar 2 has arrived in South Africa
The release of the highly anticipated discussion document for South Africa pertaining to the implementation of Pillar 2 has not disappointed. Apart from the administrative burden on South African multi-national entities (MNEs), South Africa was one of the more than 130 countries that agreed during October 2021 to implement a minimum 15% corporate tax rate for MNEs with a global turnover in excess of €750 million. This is part of the two-pillar approach that arose out of the Base Erosion and Profit Shifting (BEPS) project of the Organisation for Economic Co-operation and Development (OECD) that aims to end “ the race to the bottom ” on tax rates that has been published as part of the efforts to tax the digital economy framework.

Revised critical skills list
The Immigration Act 13 of 2002 empowers the Director-General of the Department of Home Affairs to issue a critical skills visa to an individual who is in possession of “ such skills or qualifications determined to be critical for the Republic from time to time ”, subject to meeting all the other requirements for the issuing of the visa. The skills and qualifications determined to be critical are published in a critical skills list issued by the Minister of the Department of Home Affairs (Minister) from time to time. A critical skills visa is issued based on compliance with the critical skills list and allows the holder to work in South Africa within a specific occupation listed on the critical skills list.
