In the recent judgment of Khanya Cleaning Group (Pty) Ltd v South African Transport & Allied Workers Union and Others (PR32/2023) ZALCPE 39 (2 October 2024) the Labour Court clarified the extent of an employer’s duty to make payment of severance pay to an employee dismissed for operational requirements (a retrenchment) in circumstances where the employer played an active role in securing alternative employment for the retrenched employee with a newemployer.

The Uniform Rules of Court direct that any document initiating legal proceedings must be served by the Sheriff of the High Court on a defendant/respondent. The purpose of this rule is to bring to the attention of the defendant/respondent that legal proceedings have been brought against them. The Uniform Rules of Court, however, do not always require the document instituting the legal proceedings to be personally served on the defendant/respondent. This can lead to a situation where judgment is granted against a person without their knowledge.

In the matter of Estelle Le Roux and Another v Dielemaar Holdings (Cape) Pty Ltd and Another (414/2023) ZASCA 118, three lease agreements were concluded between a close corporation as the principal debtor and the respondents (creditors), with the applicants as sureties and co-principal debtors.
