Following on our article regarding the Department of Health’s recent ban on cannabis- and hemp-infused food products
The move, originally intended to curb unregulated imports and address health concerns, inadvertently threatened 1,400 licensed hemp farms and 400 SMMEs. As mentioned in our article, Health Minister Aaron Motsoaledi had justified the ban by citing fears over uncontrolled cannabis-infused foods entering the market. However, the blanket restriction also criminalised widely accepted, non-psychoactive hemp products like hemp seed oil and flour—sparking criticism from industry leaders and policymakers.
While cannabis for private use remains legal, South Africa’s broader cannabis and hemp industry remains in limbo. Experts argue that regulation—not prohibition—is the answer, calling for clear safety and quality standards to protect consumers while unlocking economic potential. For now, the Department of Health will engage in further consultations before revising the regulations.
