Work-from-home warning in South Africa

Yvonne notes that while many employers are pushing for a return to the office, legal experts caution that any changes must align with existing agreements. Employers have the right to modify workplace arrangements, but these changes must be lawful and fair.

Yvonne says that although South Africa has no specific remote work legislation, the Labour Relations Act (LRA), Basic Conditions of Employment Act (BCEA), and employment contracts determine whether requiring employees to return is reasonable and legal.

Yvonne highlights that the BCEA mandates written employment particulars, including the place of work. If a contract specifies remote work, the employer must honour that agreement unless legally amended.
