With increasing scrutiny on the employment of foreign nationals and evolving Home Affairs regulations, businesses must stay ahead to ensure compliance and mitigate risks. This goes beyond legalities—it’s about protecting your business, ensuring compliance, and fostering ethical employment practices.

CDH experts emphasise that under the Immigration Act, employers must ensure they do not hire undocumented or improperly visaed foreign nationals. The employment of foreign workers must align with legal frameworks, ensuring they are authorised to render services in South Africa. With increased labour inspections by the Department of Labour, Home Affairs, and SAPS, compliance is more crucial than ever.  

The CDH legal experts advise that, with the Department of Labour and Department of Home Affairs confirming its ongoing compliance inspections focused on violations (particularly of the Immigration Act), employers should review the employment status of foreign workers to prevent potential breaches of immigration, employment, and criminal laws.
