Beneficial ownership information disclosure

Pursuant to Section 93A of the Kenyan Companies Act, 2015, every company is required to keep a register of its beneficial owners. To give effect to this amendment, the Government published the Companies Beneficial Ownership Information Regulations, 2020 (Regulations), which came into effect on 13 October 2020. Kenya’s affordable housing agenda is a government initiative aimed at addressing the housing deficit in the country by providing affordable and decent housing for its citizens through homeownership. This initiative aligns with the Government’s broader development goals outlined in its Vision 2030 blueprint. The key challenges that have been identified as the barriers to delivering this agenda include (i) limited capacity for rapid construction of affordable homes even though the Government has initiated large-scale construction projects across the country; (ii) lack of guaranteed off-take, which undermines property developers’ confidence in exiting developments upon completion; and (iii) limited access to financing options that could enable developers bring more affordable homes to the market.

Embracing privatisation of the rail industry in South Africa: Transnet’s Network Statement

In a move geared towards transforming the rail sector, Transnet SOC Limited (Transnet) issued its draft Network Statement (Statement) for public comment on 19 March 2024, outlining the means for privatisation of its rail network. This Statement gives effect to the rail reform set out in the National Rail Policy (adopted by Cabinet in 2022), the Freight Logistics Roadmap and the Private Sector Participation Framework. However, several elements are contentious, including the proposed minimum access fee to the rail network, proposed security measures, and the means of allocation of capacity.
