New asthma compensation regulations: Ensuring adequate treatment for affected workers

On 7 June 2024, the Minister of Employment and Labour officially promulgated two significant sets of regulations aimed at protecting workers affected by respiratory conditions. These are the Regulations on Irritant-Induced Asthma for the Compensation Fund (Irritant-Induced Regulations) and the Regulations on Work-Aggravated Asthma for the Compensation Fund (Work-Aggravated Asthma Regulations). These new regulations mark a crucial step forward in ensuring that workers suffering from asthma due to workplace conditions receive appropriate compensation and support from the Compensation Fund. This issue was previously dealt with in various circulars issued by the Director General of the then Department of Labour. Which we refer tobelow.

The central theme of the Johannesburg Arbitration Week 2024 (JAW) was showcasing arbitration in Africa. This prompted engaging discussion and renewed calls for the Africanisation of international arbitration. This encompasses African disputes being arbitrated in Africa, presided over by African arbitrators, administered by African arbitral institutions, and argued by African lawyers. With expanding foreign direct investment in Africa and the expansion of BRICS to Egypt and Ethiopia, the calls to ensure that Africa has a voice in and imprint on the international arbitration proceedings it participates in are gathering momentum. This ensures that Africa’s unique priorities and experiences are sufficiently taken intoconsideration.

The Competition Authority of Kenya imposes the highest penalty in history for anti-competitive behaviour

On 23 August 2023, the Competition Authority of Kenya (CAK) made a landmark announcement, revealing its imposition of a record penalty on nine (9) steel manufacturers totalling KES 338,848,427.89, the highest fine the CAK has meted out to date for engaging in price fixing and output restriction. In addition to the financial penalties, the CAK has mandated these companies to cease any participation in anti-competitive activities going forward. It has also required them to establish robust competition compliance programs to ensure adherence to fair market practices.
