CDH's Private Equity (Investment Funds) team advised Metier in establishing the Metier Capital Growth Fund III (a parallel fund structure in South Africa and Mauritius)
CDH's Private Equity (Investment Funds) team advised Metier in establishing the Metier Capital Growth Fund III (a parallel fund structure in South Africa and Mauritius), which raised over US$182 million at its first closing, with further commitments expected by final close to exceed its targeted fund size of US$200 million.
The fund has a geographic focus on Sub-Saharan Africa and is expected to make eight to twelve equity and equity-related investments into mid-market companies with high growth features in sectors that benefit from regional economic and demographic trends such as population growth and increased urbanisation.

The conundrum of unsolicited bids
Municipalities regularly receive unsolicited bids, which are offers by third parties on their own initiative and without an invitation from a municipality to provide the municipality with goods or services. The general principle is that municipalities are not obliged to consider unsolicited bids as they fall outside the normal bidding process. In the circumstances, when a municipality does choose to consider an unsolicited bid it must do so within the prescribed legislative framework.

The environmental (and other) legislative transitions to a low-carbon economy in South Africa
South Africa is currently enjoying a much welcomed and extended reprieve from the effects of load shedding. While there is speculation that this is merely a politically motivated state of affairs, experts suggest that the increase in solar installations at household and business levels has resulted in a significant decrease in Eskom-generated energy demand, as 2,1GW of solar has been installed in the last 12 months. Furthermore, Ember Energy estimates that solar energy contributed 10,4% to South Africa’s electricity mix in February 2024. South Africa has committed to moving towards a low-carbon economy, and the recent expansion of renewable energy installations can be seen as a significant contribution towards this goal. The transition towards a low-carbon economy cannot be achieved without the reform of enablinglegislation.

Municipalities have original constitutional powers and are directly responsible for the management of their affairs. They are required to comply with the norms and standards imposed on them by national legislation. The Municipal Finance Management Act 56 of 2003 (MFMA) was enacted to “ secure sound and sustainable management of the financial affairs of the municipalities ”, and “ to establish treasury norms and standards for the local sphere of government ”. One of the ways it does this is by recognising the possibility that expenditure may not occur in a manner that illustrates sound and sustainable management and by creating liability and recovery mechanisms around that recognition to minimise financial exposure for municipalities.
