Rate changes and the fuel sector

With effect from 2023 and following a lengthy public consultation process, the Carbon Tax Act was amended to state the exact annual carbon tax rate increases from 2023 to 2030. One of the reasons for this was to promote certainty from an investment perspective and to enable South Africa to meet its Paris Agreement commitments by gradually increasing the carbon tax rate. It therefore comes as no surprise that in the Budget it was confirmed that the carbon tax increased from R159 to R190 per tonne CO2 equivalent from 1 January 2024. Concomitantly, it was announced that the carbon fuel levy will increase to 11c/litre for petrol and 14c/litre for diesel effective from 3 April 2024.

Kenya unveils Carbon Market Regulations

The gazettement of the Climate Change (Carbon Markets) Regulations, 2024 (Regulations) on 17 May 2024, has set the stage for the regulatory oversight of carbon project development and management in Kenya. The Regulations have been enacted following a legal reform process that began with the amendment of the Climate Change Act, 2016 (Act) in 2023 to explicitly address carbon market concerns, and signal Kenya’s readiness to intensify efforts to take on opportunities presented by the global carbon markets. The Regulations introduce the key provisions outlined below.

The New Labour Court and Labour Appeal Court Rules: Transitional Arrangements

The Rules Board of the Labour and Labour Appeal Courts drafted and adopted new rules for the Labour Court and the Labour Appeal Court ("Rules"). These Rules were published on 03 May 2024 in GN 50608. The Rules replace the existing Labour Court Rules, the Practice Manual of the Labour Court of South Africa ("Practice Manual"), and the existing Labour Appeal CourtRules.

The case of Nedbank Limited v Xanita (Pty) Limited (885/2019) ZAWCHC 144 (12 June 2023) addressed and clarified the principles surrounding a guarantee and the right of recourse that a guarantor has against a principal debtor. The case also assessed the legal obligations of a guarantor in comparison to that of a surety.
