An Employer's Guide to Adjusted Level 3 Regulations

- Due to the new, more contagious strain of COVID-19, South Africa implemented adjusted level 3 restrictions with stricter penalties for non-compliance.
- Employees able to work from home during quarantine will receive full salary, while those unable to work may use annual leave or go on unpaid leave.
- Employers should inform employees about the need to self-quarantine after returning from hotspot areas and use annual leave or unpaid leave if unable to work from home. Employers cannot discipline employees for conduct outside the workplace unless it damages the employment relationship.
The Adjusted Level 3 Regulations (AL3 Regulations) were gazetted on 29 December 2020 and contain further restrictions and stricter penalties for non-compliance with a view to curbing the spread of the virus while retaining a functioning economy insofar as possible. The purpose of this guide is to assist employers in complying with their obligations in terms of the AL3 Regulations, including advice in relation to considerations pertaining to the recommencement of work in 2021.
