Discrimination v differentiation: A remuneration dispute

In 2003, the City of Johannesburg Metropolitan Municipality (Municipality) took a decision to make use of fixed-term contracts of employment for certain positions. In doing so, the Municipality invited permanent employees to convert their contracts of employment to fixed-term contracts, albeit on equal terms (converting employees). As an incentive, the converting employees were offered a salary increase of between 5% and 10%, as well as payment of an annual performancebonus.

Pasiya and Others v Lithemba Mining (Pty) Ltd and Others 1 All SA 626 (SCA) was an appeal before the Supreme Court of Appeal (SCA) following the dismissal by the court a quo of the appellants’ application for declaratory relief. The declaratory relief sought included an order (i) declaring as unlawful and setting aside a loan agreement concluded in 2009; (ii) declaring as unlawful and setting aside the changes to shareholding which occurred in January 2010 pursuant to the inability of the borrower to repay the loan; and (iii) directing that dividends be paid in terms of shareholding as it stood before the shareholdingchanges.

Amid the international push towards sustainability and energy efficiency, retrofitting existing buildings into greener models is a crucial strategy for reducing the consumptive effect that the built environment has on its surroundings. Buildings typically account for 40% of a city’s total energy usage, with electricity in the built environment accounting for nearly a quarter of South Africa’s carbon emissions. Retrofitting existing structures can thus play a significant role in infusing the built industry with environmentally-sustainablesolutions.

National Treasury provides update on South Africa's progress in getting off the FATF grey list

National Treasury released a statement providing feedback on South Africa's participation in the October 2024 Financial Action Task Force (FATF) Plenary, where FATF recognised the improvements made in South Africa's structures to monitor and prevent anti-money laundering/combatting the financing of terrorism (AML/CFT).
