The Podcast considers the case of Lindokuhle Tsibani v Estate Agency Affairs Board and Others - Case no: J 642/2021. This was an urgent application to the Labour Court where Ms Tsibani alleged that she was an employee who in good faith believed that the holding of an inquiry by her employer contravened the Protected Disclosures Act. Ms Tsibani tried to avoid the internal enquiry, after it had already commenced, by invoking the provisions of section 188A of the LRA to have the CCMA, as an independent body, hear the allegations against her.
